“Madhya Pradesh: ‘Sar tan se juda’ slogans in Ratlam after an allegedly controversial social media post against Islam; case registered against Instagram user”, Opindia, August 10, 2023:

“On Wednesday, August 9th, 2023, a mob created a ruckus in front of the police post in Ratlam, Madhya Pradesh, during the night. This followed after an allegedly contentious social media post about Islam sparked outrage among members of the Muslim community. The situation escalated rapidly, with irate Muslims converging at the police post to voice their anger while chanting ‘sar tan see juda’ slogans.

The demonstration swelled in size within a short span, as Muslims demanded stringent action against the individual behind the controversial post. As tensions heightened, the scene drew the attention of the police station in charge, along with officers from two police stations, and the CSP.

The commotion subsided following interventions by social workers and law enforcement authorities. Police said, “An investigation has been initiated against an unidentified female, and efforts are underway to locate her. The objective now is to ascertain the actual operator behind the Instagram account……”

“On Tuesday, August 8, Yadgir Town Police in Karnataka arrested two Muslim youths for hate speech over a social media post threatening to behead those who ‘insult’ Prophet Muhammad. The accused have been identified as Akbar Syed Bahadur Ali and Mohammad Ayaz. Both the accused are residents of Hattikuni Cross in Yadgir. 

Recently, a video of the two accused Akbar Syed Bahadur Ali and Mohammad Ayaz went viral over social media wherein the two were heard saying that they have been taught since childhood not to tolerate ‘insult’ of Prophet Mohammad and to behead those who do so.

The two further challenge Hindus for a 15-minute face-off. As seen in the video, AIMIM chief Asaduddin Owaisi’s picture is in the background as Akbar Syed and Mohammad Ayaz reiterated AIMIM leader Akabaruddin Owaisi’s “remove the police for 15 minutes and we will see who is more powerful” remark made in 2012…..”

“On August 8, the Supreme Court of India rejected Senior Advocate Kapil Sibal’s arguments in favour of a Brexit-like referendum in a plea challenging the amendment of Article 370, which abrogated the special status of Jammu & Kashmir.

“Ultimately, this was a political decision taken in the context of the situation prevailing. Right? And the complete abrogation must also be a political decision. Your lordships must remember Brexit. What happened? There was no constitutional provision seeking a referendum. But when you want to severe a relationship, you must seek the opinion of the people. Because people are central to the decision,” Kapil Sibal argued in favour of a Brexit-like referendum in J&K.

“In a constitutional democracy, seeking the opinion of people has to be through established institutions. So long as democracy exists, any recourse of will of people has to be expressed by established constitution. So you cannot envisage a Brexit-type referendum. That’s a political decision which was taken by the then government. But within a constitution like ours, there is no question of a referendum,” Chief Justice of India DY Chandrachud said…..”

“On 31st July, a Muslim mob in Nuh of Mewat, Haryana, attacked thousands of Hindu devotees attending the Jalabhishek Yatra on Shravan Somvar. OpIndia accessed several FIRs registered in the case.

One of the FIRs in the case was registered on the complaint of Bharatiya Janata Party (BJP) leader Shiv Kumar Arya under Sections 148, 149, 379B, 435, 427 and 153A of the Indian Penal Code (IPC). As per the complaint, Arya’s oil mill was burnt to ashes, and he suffered a loss of around Rs 1,53,18,000 due to the arson.

In his complaint, Arya said he owns an edible oil mill at Badkali crossing on Punhana Road in the village Nagina under the Nagina police station area, district Nuh, Haryana. On 31st July, Arya was at his shop when around 2 PM, Muslim rioters started damaging and burning shops in the market. Arya closed the shop and rushed back home for his safety. At around 3 PM, Muslims reached his shop and broke down the locks and shutter…..”

“On Wednesday, August 9, the Uttar Pradesh police filed an FIR against one individual identified as Hanif Ladku for intoxicating a girl with drugs and raping her. The accused also threatened the girl and forced her to convert her religion to Islam.

According to the reports, the incident is said to have happened in the Nichlaul region of Uttar Pradesh’s Maharajganj. The girl knew the accused for around 5 years who deceptively fed her drugs before raping her. The accused is also said to have shot the incident on his phone which he used to blackmail the girl for additional sexual favors.

The accused knew the family of the girl as well. He approached to help the girl when she was ill recently. He fed the girl with drugs under the guise of providing her with medicines…..”

“On August 9, the Indore police arrested a cleric for spreading hate and issuing castiest slurs against sanitation workers. The cleric has been identified as Maulana Shadab Khan. One of his videos where he can be seen abusing sanitation workers went viral on social media, and following the rage, the police registered an FIR (First Information Report) against him.

In the video that went viral on the internet, Maulana could be heard saying, “Now we won’t allow our daughters, sisters, and wives to throw the garbage into the sanitation van. We pay due taxes and also extra garbage tax. We’ll throw more Rs 60 per/month (Rs 2 per day) on the faces of the sanitation workers, but they will only have to pick up the garbage.”

Stating the reason behind this declaration, Maulana said, “I have seen when ladies from our community raise their hands to throw the garbage into the van, their clothes also rise from the waist, and these sanitation workers shamelessly watch the ladies in that condition…..”

“Rajasthan: Money lender Mehrdeen rapes woman for not being able to repay interest on loan she took for her husband’s treatment, arrested”, Opindia, August 10, 2023:

“On Wednesday, August 9, the Nagaur police in Rajasthan, informed that it has arrested a money lender identified as Mehrdeen for allegedly raping and blackmailing a married woman in his neighbourhood.

The action was taken based on a complaint filed by the woman on August 7 at Nagaur police station wherein she alleged that Mehrbeen raped her once five months ago and then later once in Jodhpur. He committed the heinous crime on the pretext of the loan he had given her a few months ago for her husband’s medical treatment.

The woman said in the complaint that she had taken Rs 10,000 as a loan from the accused Mehrbeen for the treatment of her ailing husband, who was suffering from paralysis. She had returned Rs 5000 to Mehrbeen and was continuing to return the remaining Rs 5000 in monthly instalments of Rs 500…..”

SC judge PK Mishra, who had opposed relief to Hindu-baiter Teesta Setalvad, recuses from hearing Islamist Umar Khalid’s bail plea

The Supreme Court on Wednesday adjourned hearing on the bail plea filed by student activist Umar Khalid after Justice Prashant Kumar Mishra recused himself from hearing the matter.

“This will come before some other bench. There is some difficulty on part of my brother (Justice P.K. Mishra),” told a bench headed by Justice A.S. Bopanna to the parties. 

The court has directed listing of the plea before a different bench on August 17. 

Khalid was arrested and charged under the Unlawful Activities (Prevention) Act in connection with the alleged larger conspiracy case behind the 2020 Delhi riots.

Khalid has approached the top court against denial of bail by the Delhi High court.

A bench of Justices Siddharth Mridul and Justice Rajnish Bhatnagar of high court has rejected Khalid’s appeal seeking regular bail on October 18 last year. He had challenged the trial court order which had denied him bail in connection with the UAPA case.

His alleged offensive speeches delivered at Amaravati during the protests against the Citizenship Amendment Act and the National Register of Citizens were the basis of allegations against him in the riots case.

JNU scholars and activists Khalid, and Sharjeel Imam are among the nearly a dozen people involved in the alleged larger conspiracy case linked with the Delhi riots 2020, as per the Delhi Police. 

The riots broke out in the national capital in February 2020 as clashes between the anti-CAA (Citizenship Amendment Act) and pro-CAA protesters took a violent turn, in which more than 50 people lost their lives and over 700 were injured.

Industry hails passing of historic data protection bill

Leading industry leaders and stakeholders hailed the passing of Digital Personal Data Protection Bill (DPDP) 2023 by the Parliament as it secured the Rajya Sabha’s nod on Wednesday, terming it a “watershed moment”.

Nasscom said this marks a significant leap forward for Bharat to establish a robust framework for personal data protection and build Bharat as a trusted data destination.

Ensuring comprehensive data protection is paramount for accelerating Bharat’s digital economy and the bill strikes a harmonious balance between flexibility and data privacy measures, it said.

“The technology industry and Nasscom have been working collaboratively with the government from the start to share insights and industry experiences from global regulations, the India differentiators and provided detailed submissions through the evolution of this Bill,” Nasscom President Debjani Ghosh said.

According to some of the key recommendations which are reflected in the Bill, the concept of purpose limitation and data minimisation should be provided in the law.

“The law should enhance trust in processing data in India. Processing of foreign data in India should avoid overlaps with the laws of the countries whose data is being processed,” said the IT industry’s apex body.

Accordingly, the bill provides that companies processing foreign data in Bharat will need to adhere to security safeguards to prevent personal data breaches under the law.

“Obligations should be risk-based so that start-ups and small and medium enterprises are not unduly burdened,” Nasscom said in a statement.

Sivarama Krishnan, Partner & Leader, Risk Consulting, PwC India, said the DPDP Bill 2023 is a much-needed leap in the right direction as it establishes the rights and duties of ‘Data Principals’, the owners of data, and the obligations and liabilities of ‘Data Fiduciaries’, who collect, store, and process the data.

“The Bill places reasonable obligations on data fiduciaries, ensuring responsible handling of digital personal data. Introduction of consent managers, additional obligations on Significant Data Fiduciary and verifiable parental / guardian consent for are welcome inclusions to bill,” Krishnan said.

Union Telecom Minister Ashwini Vaishnaw moved the Digital Personal Data Protection Bill, 2023 for consideration and passing in the Rajya Sabha after the Lok Sabha had already passed it.

Murali Rao, Cybersecurity Consulting Leader, EY India said that the DPDP Bill is Bharat’s first data protection act, and it establishes a framework for the processing of personal data in Bharat.

“As the next steps towards the enforcement journey, a Data Protection Board needs to be set up and rules to be released through separate notifications which could be for specific parts of the law,” Rao noted.

Vihang Virkar, Partner, Lumiere Law Partners, said that it is time that Bharat established a robust legal mechanism to protect personal data of its citizens, in line with global standards.

“The current legal framework in India dealing with protection of personal data is formed of an assortment of legal provisions which can be found in various separate legislation. While India is moving rapidly to become a dominant player in the global digital economy, it is important that the existing collage of data protection laws in India be unified into a single statute,” Virkar added.

“हरियाणा के करनाल की 14 साल की एक किशोरी ने पढ़ने के लिए यूपी के शामली स्थित मदरसे में दाखिला लिया था। नामांकन के बाद 10 दिन तो सब कुछ ठीक रहा, फिर मौलाना की नीयत खराब हो गई। मौलाना रोज उसके साथ छेड़छाड़ करने लगा और मना करने पर उसकी पिटाई करने लगा।

इतना ही नहीं, एक दिन मौलाना ने किशोरी को दबोच लिया और 5 घंटे तक रेप को अंजाम दिया। किशोरी के साथ हो रही बर्बरता की जानकारी करनाल के बाल कल्याण समिति तक पहुँची। काफी मशक्कत के बाद किशोरी को मौलाना के चंगुल से निकाला गया। बताया जा रहा है कि मौलाना किशोरी को मदरसे से बाहर निकलने नहीं देता था।

भास्कर की रिपोर्ट के मुताबिक, शामली के गढ़ी पुख्ता में यह मदरसा है। पीड़ित किशोरी यहाँ 20 जून 2023 से आई थी। 10 दिन तो सब कुछ ठीक से गुजरे थे, लेकिन इसके बाद मौलाना की नीयत बदल गई और वह उसके साथ छेड़छाड़ करने लगा। मना करने पर मौलाना किशोरी की पिटाई करता था…..”
