SCs call to the Centre for repealing the sedition laws

‘Why aren’t you repealing British era sedition law, SC asks the Centre’- This was the caption on the front page of The Times of India dated 16th July, 2021.

Subsequently there was a lot of media coverage and most prominently the Opposition leaders welcomed the move. According to the CJ NV. Ramana the main concern was the misuse of the law. It is understandable that the non-bail able provisions of the Act are misused by the police to fix certain persons etc. It is true to some extent and granted that the law is misused it is the SC which should prevent the misuse of the law.

One cannot throw the baby with the bathwater tub. True the law was used to silence the Freedom fighters. But that does not mean the law is useless today. Its utility does not belong only when there is foreign rule.

Today no wars and no armies will invade any country to establish an empire. But that does not mean there are no sedition and the risk of danger to topple elected governments. The world over one witnesses the unrest-the conspiracies, the terrorism and the toppling of elected governments. How these be prevented without these being ruthlessly put down under treason and sedition?

Sedition is very much present in Bharat. No wonder the Opposition leaders welcomed the SC’s call. Creating unrest, spreading false and malicious rumors with the intend to fix the Government and inciting people to protest thereby looting-burning destroying vehicles and preventing the rights of others by blocking roads and highways etc.

Lives of people are lost-so too properties in the rampage and the violence. Why should foreigners interfere in the protests in Bharat? The Farmers protest is an example. The amount of money that flowed from Canada and UK to keep the protestors on the road-giving them all comforts including badam milk throughout the day -air coolers- woolens in winter, roti making machines- pucca house with all facilities- all this towards what, repealing the Farm Laws but in the process are not the ordinary citizens ‘s rights denied. Is this not directed to hurt the GOI and create instability?

Now it is fine if this is carried on only by the Bharatiya farmers, what is the role of the foreigners in this-both media and persons? They may be of Bharatiya origin but they have no business in creating instability. What was the role of the SC? For that matter even the police was not able to create an atmosphere of peace and calm for other law abiding citizens of this country.

It will be of importance to know why the campuses of a few universities have become areas for propaganda and incitement against the country. Raising the Pakistan flag in a university campus is just not a misbehavior but treason. Will anyone dare to raise the Bharatiya flag in Pakistan or for that matter in any other country? Sedition and treason are very much alive but in different forms.

The law may be 75 years old and used by the British to silence Mahatma Gandhi, Gokhale and others observed CJ. So what? It has its use even today because sedition and treason are very much alive in various forms. What is needed is the prevention of its abuse. The SC could get its work done-after all with 4.5 crores of cases pending it is time for the SC to be made accountable. This is a good task and not just attending to the flow of PILs but getting its tasks done and upholding justice without violating into the terrain of the Executive.

If the Government is accountable to the Parliament, then one wonders to who is the judiciary accountable. Not only for piling up the load of pending cases but also for  failing to uphold equality when it comes to the offenders for the same kind of offence. Some get bail 25 times-some get three cells made into one for the benefit of walks some are allowed home food et al, but the majority are huddled and crammed in cells for years with no one to take up the cases for years.

Will the Judiciary please get down doing its homework and upholding justice? Time for the people of to make the Judiciary accountable for it is the people’s money which made the salaries of the Judges so weighty. I hope this will not come under sedition and treason!
